1. Acceptance of Terms

By accessing or using Love2Taste, you confirm that:

• You are at least 21 years old (or the legal drinking age in your jurisdiction)
• You have the legal capacity to enter into a binding agreement
• You will comply with these Terms and all applicable laws and regulations
• You have read and understood our Privacy Policy

2. Description of Service

Love2Taste is a wine discovery and information application that provides:

• Wine Recognition: AI-powered wine label and bottle recognition through camera scanning
• Wine Information: Detailed information about wines including origin, grape varieties, vintages, and ratings
• Tasting Notes: Expert tasting notes describing appearance, aroma, palate, and finish
• Food Pairing Suggestions: Recommendations for food and wine pairings
• Personal Collection: Ability to save and organize wines in your personal collection
• Wine Recommendations: Personalized wine suggestions based on your preferences
• Serving Recommendations: Optimal serving temperature, decanting advice, and glassware suggestions

3. Account and Registration

To use certain features of Love2Taste, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Subscription Plans and Pricing

4.1 Free Plan

Love2Taste offers a free plan with the following limitations:

• 10 wine scans per month
• Monthly scan limit resets on the first day of each calendar month
• Access to basic wine information and recommendations
• Unlimited storage of scanned wines in your collection

4.2 Premium Subscriptions

We offer the following premium subscription plans:

• Weekly Plan: Auto-renewing weekly subscription with a 3-day free trial for new users
• Yearly Plan: Auto-renewing annual subscription (no free trial)

4.3 Premium Features

Premium subscribers receive:

• Unlimited wine scans per month
• Access to all wine information and features
• Priority customer support
• Ad-free experience (if applicable)

4.4 Free Trial

The Weekly Plan includes a one-time 3-day free trial for new users who have never subscribed before. You will be charged the subscription fee at the end of the trial period unless you cancel before the trial expires. A notification will be sent 1 day before your trial ends to remind you of the upcoming charge.

4.5 Billing and Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription prices are displayed in the App and may vary by region
• Prices are subject to change with notice for new subscriptions; existing subscribers will be notified of price changes

4.6 Cancellation and Refunds

• You can cancel your subscription at any time through your device's subscription settings (App Store or Google Play)
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Refunds for subscriptions purchased through the App Store or Google Play are subject to Apple's and Google's respective refund policies

4.7 Restore Purchases

You can restore your premium subscription on any device by using the "Restore Purchases" option in the App settings. This allows you to access your subscription across multiple devices.

5. Acceptable Use

5.1 Permitted Use

You may use Love2Taste for personal, non-commercial purposes to:

• Scan wine labels and bottles for personal wine discovery
• Access wine information and recommendations
• Build and manage your personal wine collection
• Export your wine data for personal use

5.2 Prohibited Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws regarding alcohol consumption or distribution in your jurisdiction
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated systems (bots, scrapers) to access the App
• Circumvent any usage limits or restrictions (e.g., monthly scan limits)
• Sell, resell, or commercially exploit the App or its content
• Upload malicious code or attempt to harm the App's infrastructure
• Misrepresent your identity or affiliation
• Harass, abuse, or harm other users or our support team
• Interfere with or disrupt the App's operation

6. Intellectual Property Rights

6.1 Our Rights

Love2Taste and all its content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. This includes:

• The App's design, layout, and user interface
• Wine information, tasting notes, and recommendations generated by our AI
• The Love2Taste name, logo, and branding
• All software, algorithms, and technology underlying the App

6.2 Your Rights

You retain ownership of:

• Photos you take with the App
• Your personal wine preferences and settings
• Your saved wine collection

By using the App, you grant us a limited license to process your photos solely to provide wine recognition services.

6.3 Third-Party Content

Wine information, ratings, and reviews may include content from third-party sources. We do not claim ownership of this content and credit sources where applicable.

7. Disclaimers and Limitations of Liability

7.1 Wine Information Accuracy

Love2Taste provides wine information for educational and informational purposes. While we strive for accuracy, we make no guarantees regarding:

• The accuracy, completeness, or reliability of wine information
• The correctness of wine recognition results
• The availability or accuracy of ratings and reviews
• The accuracy of price estimates or availability information

Wine information should not be used as the sole basis for purchase, consumption, or investment decisions.

7.2 Health and Legal Disclaimers

• Love2Taste is intended for users of legal drinking age
• We do not encourage excessive alcohol consumption
• Please drink responsibly and know your limits
• We are not liable for any consequences of alcohol consumption
• Consult a healthcare professional regarding alcohol consumption if you have health concerns

7.3 Service Availability

Love2Taste is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• That the App will meet your specific requirements
• That defects will be corrected
• That the App is free from viruses or harmful components

7.4 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from reliance on wine information provided by the App
• Damages arising from unauthorized access to your account

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

8. Third-Party Services and Links

Love2Taste may integrate with or link to third-party services, including:

• OpenAI for wine recognition and information retrieval
• Firebase for analytics and data storage
• Wine retailers and review websites

We are not responsible for the content, privacy practices, or terms of these third-party services. Your use of third-party services is governed by their respective terms and policies.

9. User Data and Privacy

Your use of Love2Taste is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Termination

10.1 Termination by You

You may stop using Love2Taste at any time by:

• Uninstalling the App from your device
• Canceling your subscription
• Using the "Clear All Data" option to delete your information

10.2 Termination by Us

We reserve the right to suspend or terminate your access to Love2Taste at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of subscription fees

10.3 Effect of Termination

Upon termination:

• Your access to premium features will cease immediately
• Your subscription will not be refunded (unless required by law)
• You will lose access to any data stored on our servers
• Local data on your device will remain until you delete the App

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

11.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of Love2Taste:

• You agree to first attempt to resolve the dispute informally by contacting us
• If informal resolution is unsuccessful, disputes will be resolved through binding arbitration or in the courts of Ukraine
• You waive any right to participate in class-action lawsuits or class-wide arbitration

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Effective Date" at the top of this document
• Sending you a notification (for significant changes)

Your continued use of Love2Taste after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

13. Indemnification

You agree to indemnify, defend, and hold harmless Love2Taste, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Love2Taste regarding your use of the App and supersede all prior agreements and understandings.

16. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision. No waiver shall be effective unless made in writing.

17. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.
